Refund & Cancellation Policy
Transparent, escrow-backed refund and cancellation policy based on milestone delivery, unworked fund protections, and fair-play defect resolution.
Fair-Play Milestone Refund Philosophy#
LETSCOOKTECH operates strictly on milestone-based escrow delivery sprints (typically 1–2 weeks per milestone). We do not lock clients into predatory long-term retainers or non-refundable lump-sum upfront packages.
Document ID: LCT-REFUND-001 Status: ACTIVE Version: 3.0 Classification: PUBLIC CLIENT-FACING POLICY
Our refund doctrine is simple, ethical, and transparent: 1. Work that has not commenced is 100% refundable. 2. Work that has been delivered, reviewed in User Acceptance Testing (UAT), approved by the client, and for which 100% source code and IP has been transferred is earned and non-refundable. 3. In-progress milestones canceled mid-sprint are reconciled transparently based on actual verifiable deliverables produced up to the stop-work notice.
- Milestone-based financial safety: funds held in escrow for future milestones remain client property until milestone kickoff.
- Zero hostage code: when a milestone is completed and paid, all source code, design assets, and credentials for that milestone are handed over immediately.
- Written transparency: every reconciliation or refund request receives an itemized written accounting within 5 business days.
1. Pre-Kickoff Cancellation & Advance Escrow#
If a client deposits advance milestone escrow and subsequently decides to cancel the project prior to formal kickoff or the start of Milestone 1 development:
• 100% Refund: Any escrow deposit for uncommenced development work will be refunded in full minus only direct third-party payment gateway transaction fees. • Notice: The client must provide written notice of cancellation via email to letscooktech@gmail.com from the authorized organizational contact. • Timeline: Refunds are processed back to the original payment method within 5 to 7 business days.
2. Mid-Project Milestone Escrow Reconciliation#
For active projects structured across multiple milestone sprints:
• Future Uncommenced Milestones: If either party terminates the agreement mid-project, 100% of escrow funds deposited for future milestones that have not yet commenced will be promptly refunded to the client. • Current Active Milestone in Progress: If cancellation occurs while a milestone sprint is actively underway, LETSCOOKTECH will halt work immediately. A transparent reconciliation will be conducted: the client is only responsible for the proportionate hours and verifiable deliverables produced up to the stop-work order. Any unspent balance of that milestone deposit will be returned. • Completed and Accepted Milestones: Once a milestone has completed User Acceptance Testing (UAT) and has been signed off by the client, the escrow for that milestone is released. Because full source code, intellectual property, and access have been transferred, completed milestones are non-refundable.
- Escrow deposit is held securely sprint by sprint.
- Immediate work-stop upon receipt of cancellation notice prevents unnecessary costs.
- Client retains all code, documentation, and assets produced up to the termination date.
3. Discovery Workshops & Solution Blueprints#
Discovery & Solution Blueprint engagements (Offer 3) are fixed-scope, advisory sprints that produce Architecture Decision Records (ADRs), technical specifications, data models, and implementation roadmaps.
• Prior to the discovery workshop: 100% refundable upon written notice. • After the workshop is conducted and custom architectural artifacts are produced and delivered: non-refundable, as the strategic advisory value and intellectual deliverables have been fully rendered to the client.
4. 30-Day Fair-Play Defect Warranty vs. Refund Claims#
LETSCOOKTECH stands behind the engineering quality of its deliverables. Every completed custom development project includes an express 30-Day Post-Launch Defect Warranty.
• If a functional bug or deviation from the agreed SOW acceptance criteria is identified within 30 days of production deployment, LETSCOOKTECH will investigate, diagnose, and remediate the defect free of charge with high priority. • Warranty defects are addressed through corrective engineering, not monetary refunds, ensuring the client receives a fully operational, battle-tested system matching the agreed specification.
- 30-day warranty covers reproducible functional bugs matching agreed SOW scope.
- Critical defects (Severity P1) receive emergency response within 4 hours.
- Issues caused by unauthorized third-party modifications or client infrastructure changes are excluded from warranty.
5. Non-Refundable Pass-Through Third-Party Costs#
Direct third-party costs and infrastructure disbursements paid to external vendors are non-refundable once incurred. These include:
• Domain name registration and DNS provisioning fees • Cloud hosting, compute, and database subscriptions (e.g. AWS, Supabase, Vercel) • Paid third-party API credits or LLM model tokens (e.g. OpenAI, Anthropic, Google Cloud) • Third-party software licenses, commercial plugins, or payment gateway setup fees
Where LETSCOOKTECH purchases infrastructure on the client's behalf, ownership of all subscriptions and accounts is transferred directly to the client.
6. Care & Maintenance Retainer Cancellation#
Ongoing Care & Improvement retainers (Offer 7) operate on a flexible monthly billing cycle:
• Clients may cancel a monthly Care retainer at any time with 30 days' written notice. • No long-term lock-in or cancellation penalties. • Any unutilized prepaid hours in the active month will be prorated or utilized for maintenance transition.
- Cancel anytime with 30-day notice.
- Complete handover of maintenance logs, monitoring dashboards, and deployment runbooks.
7. Dispute Resolution & Fair-Play Mediation#
If a disagreement arises regarding milestone acceptance, scope interpretation, or refund eligibility, LETSCOOKTECH is committed to fair-play resolution:
1. Good-Faith Discussion: Within 5 business days of written notice, designated leadership from both parties meet via video call to review the Requirements Baseline, UAT Acceptance Record, and project evidence. 2. Evidence-Based Reconciliation: Outcomes are determined based on written SOW deliverables and verified test evidence rather than subjective impressions. 3. Independent Technical Mediation: If mutual agreement cannot be reached, the parties agree to submit the technical evidence to an independent technical mediator before pursuing formal arbitration.
- All disputes handled with documented factual evidence.
- Commitment to transparent, ethical, and collaborative resolution.
